Livestream Class Agreement

This agreement applies to Siudy Flamenco Livestream, the monthly subscription that lets you take our classes by livestream over Zoom, from wherever you are. It is in addition to our Terms of Use and Refund Policy, which continue to apply.

It exists because taking class at home is not the same as taking class in our studio. In the studio there is a sprung floor, a room we control, and an instructor who can reach you. On a livestream there is none of that, and this sets out honestly what that means for both of us.

1. Where You Dance Is Your Responsibility

You choose the space you dance in, and you are responsible for making it safe. Before each class you agree to check that you have:

A firm, level, non-slip floor with enough clear space to move, turn, and travel without striking anything.
No furniture, rugs, cables, pets, children, glass, or other hazards within your dancing area.
Adequate lighting and ventilation, and water within reach.
Footwear appropriate for your floor. Flamenco footwork places sharp, repeated force through the heel and toe; nailed shoes can damage some surfaces and slip on others.

We cannot see your space, and we are not able to inspect or approve it. You accept that choosing where and how to dance is yours alone.

2. Physical Risk and Your Own Fitness

Flamenco is physically demanding. It involves percussive footwork, sustained posture, rapid turns, and repeated impact through the feet, ankles, knees, hips, and spine. Participation carries a real risk of injury, including serious injury.

By taking part you confirm that:

You are in sufficient health to take part, and you have consulted a physician if you have any reason to.
You will work within your own limits, and will stop if you feel pain, dizziness, or distress.
You understand that no instructor is physically present, that we cannot observe you closely through a camera, and that we cannot intervene or give first aid.
You are responsible for summoning your own medical help if you need it.

You assume these risks voluntarily, and you release Siudy Flamenco Company, its instructors, employees, and contractors from liability for injury, loss, or damage arising from your participation, to the fullest extent permitted by Florida law.

3. If You Are Under 18

A subscription must be bought and held by an adult. If the person dancing is under 18, a parent or legal guardian must accept this agreement on their behalf, must be present or within immediate call for the whole of each class, and remains responsible for the minor’s safety and supervision throughout.

4. Cameras, Recording, and Other Students

These are livestream classes with other people in them. You should expect to be seen.

You may be asked to keep your camera on so an instructor can correct you. You are never required to, and you may turn it off at any time.
Your name, image, and voice may be visible to the instructor and to other participants.
We may record classes for teaching, review, and training purposes. If we do, you may appear in the recording, and you consent to that use. Tell us in writing before class if you do not wish to appear, and we will accommodate you where we reasonably can.
You may not record, photograph, screenshot, stream, or transmit any part of a class, including other participants, for any reason. This protects your classmates as much as it protects us.

Point your camera only at yourself and your dancing area, and be mindful of who else is in the room and what is visible behind you.

5. The Class Content Is Ours

Choreography, exercises, drills, music selections, and teaching materials shown in class are the intellectual property of Siudy Flamenco Company. Your subscription buys you a personal, non-transferable license to take part in class. It does not allow you to teach the material, perform it commercially, reproduce it, or share it.

Your access link is personal to you. Do not forward it, post it, or let anyone else use your account.

6. Your Connection, and Ours

Classes are delivered over Zoom, a third-party service, across the public internet. We cannot guarantee uninterrupted or fault-free delivery.

You are responsible for your own device, internet connection, speakers, and Zoom software.
Interruptions caused by your own equipment or connection are not grounds for a refund or credit.
If a class is materially disrupted by a failure on our side, tell us within seven days and we will offer a replacement class or credit at our discretion.

7. Schedule, Substitutions, and Cancellations

The published schedule is our intention, not a guarantee. We may change class times, substitute instructors, or cancel a session — for holidays, illness, travel, or any other reason. Where a class is cancelled by us, we will tell you as early as we reasonably can.

The instructor shown on the schedule is who we expect to teach. On occasion — in an emergency, or for any other reason — another member of our faculty may teach the class instead. A change of instructor is not a cancellation and does not entitle you to a refund or credit.

Missing a class does not extend your subscription or entitle you to a credit. A livestream class is a fixed occasion; if you cannot attend, it passes.

8. Conduct in Class

Behave in a livestream class as you would in the studio. We may remove any participant, without refund, whose conduct is disruptive, disrespectful, harassing, or unsafe. This includes anything shown on camera.

9. Billing, Renewal, and Cancelling

The subscription bills monthly in advance and renews automatically until you cancel.
Payments are processed by Stripe. You authorize recurring charges to your payment method until cancellation.
Cancel in writing to classes@siudyflamenco.org. Our Refund Policy sets out the notice required and applies in full to this subscription.
Payments already made are non-refundable, including for change of mind and for classes you did not attend.
If a payment fails, access to livestream classes may be suspended until it is resolved.
We may change the price with at least thirty (30) days’ notice before it takes effect.

10. What the Subscription Includes

Siudy Flamenco Livestream gives you access to the livestream Zoom sessions on the published schedule, with your schedule and Join links in My Zone at siudyflamenco.org. It does not include in-person classes at the North Miami studio, private lessons, workshops, intensives, or performance tickets, each of which is sold separately.

11. General

We may update this agreement. Changes take effect when posted, and the version you accepted is recorded with your acceptance. Your continued use after a change constitutes acceptance of the revised agreement.

This agreement is governed by the laws of the State of Florida, without regard to its conflict-of-law rules. If any provision is found unenforceable, the rest remains in force.
